General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions apply to all orders placed by consumers via the online shop of: Florian Hahn Naintsch 170 8184 Anger Austria

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.

2. Contracting Party

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order. By submitting an order, you are making a binding offer to enter into a purchase agreement. The contract is concluded as soon as an order confirmation is sent by email or the goods are dispatched.

4. Prices

  • All prices are stated in Euro (EUR).

  • Pursuant to § 6 para. 1 line 27 UStG (Small Business Regulation/Kleinunternehmerregelung), no VAT is charged or displayed.

  • Shipping costs are displayed separately during the ordering process.

  • For deliveries to non-EU countries, additional customs duties, taxes, or import charges may apply, which are to be borne by the buyer.

5. Payment

Payment is processed via the following methods:

  • Credit or Debit Card via Wix Payments

  • Apple Pay

  • Google Pay

  • PayPal The purchase price is due immediately upon completion of the order.

6. Delivery

  • Delivery is made to the address specified by the customer within the European Union and worldwide.

  • Delivery times are generally 1 to 3 weeks, depending on the product, stock availability, and shipping destination.

  • Should an item be unavailable, the customer will be informed immediately.

  • Partial deliveries are permitted insofar as they are reasonable for the customer.

  • For consumers, the risk of accidental loss or damage to the goods passes to the customer only upon delivery of the goods.

7. Retention of Title

The goods remain the property of the seller until full payment has been received.

8. Right of Withdrawal

Consumers are generally entitled to a statutory right of withdrawal. Details regarding the right of withdrawal can be found in the separate Cancellation Policy on this website.

9. Exclusion of the Right of Withdrawal

A right of withdrawal does not exist for:

  • Goods manufactured to customer specifications.

  • Goods clearly tailored to personal needs.

  • Sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

10. Warranty

The statutory warranty provisions of Austrian law apply. The warranty period is two years from the delivery of the goods. In the event of a defect, the statutory rights to remedy (repair), replacement, price reduction, or rescission of the contract exist.

11. Liability

  • The seller is liable without limitation for damages resulting from injury to life, body, or health, as well as in the event of intentional or grossly negligent breach of duty.

  • In the event of a slightly negligent breach of essential contractual obligations, liability is limited to foreseeable damage typical for the contract.

12. Applicable Law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection regulations of the country in which the consumer has their habitual residence remain unaffected.

13. Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
